These terms describe how you may use Just Set Alarm. Please review them carefully. By using the service, you agree to these terms.

These Terms of Use (the "Terms") govern your access to and use of Just Set Alarm (the "App", "we", "us", or "our") and the website located at justsetalarm.com (the "Website"). The App is operated by Totally Awesome Software, a sole proprietorship operating in the Province of British Columbia, Canada.

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the App.

1. Eligibility

The App is intended for a general audience aged 13 and older. If you are under 13, you must not use the App. If you are between the ages of 13 and the age of majority in your place of residence, you represent that you have permission from a parent or legal guardian to use the App.

2. The App and How It Works

The App provides a browser-based alarm and timekeeping utility. The App operates within your web browser and is dependent on your device, operating system, browser settings, power management features, and other third-party factors outside of our control.

You acknowledge and agree that the App is not a guaranteed or fail-safe alarm service.

3. No Guarantee of Alarm Reliability

While we aim for the App to function as intended, you acknowledge and agree that alarms may not trigger, may not play audible sound, may be delayed, or may otherwise fail for reasons including, without limitation:

  • Browser restrictions, including autoplay and audio permission requirements
  • Browser or operating system suspension of background tabs, timers, or scripts
  • Device sleep, lock state behavior, battery saver/low power mode, or other power optimization features
  • Muted volume, silent mode, Do Not Disturb, Focus modes, or similar settings
  • Audio output routing issues, including Bluetooth or external device disconnection
  • Network interruptions, device performance limitations, or lack of system resources
  • User configuration errors, including incorrect time, time zone, or alarm settings
  • Updates or changes to your device, browser, or operating system

Accordingly, the App is provided on a "best-effort" basis only. We do not represent, warrant, or guarantee that any alarm will trigger at a particular time, sound audibly, or function without interruption or error.

4. User Responsibilities

You are solely responsible for ensuring that the App is suitable for your intended use. Without limiting the foregoing, you are responsible for:

  • Keeping the App accessible and, where required, keeping the browser tab or window open
  • Ensuring your device and browser permit audio playback, including completing any required user interaction to enable sound
  • Ensuring your device volume is audible and that silent mode, Do Not Disturb, Focus modes, or similar settings will not prevent playback
  • Maintaining power and device settings (including sleep and battery optimization settings) that may affect alarms
  • Testing alarms prior to relying on them
  • Verifying time, time zone, and alarm configuration accuracy

5. No Emergency or Safety-Critical Use

The App is not intended for emergency, medical, safety-critical, or other high-risk uses. You agree not to rely on the App for situations where failure could result in injury, harm, property damage, or other material consequences. The App is not a substitute for dedicated alarm devices, emergency alert systems, or other safety mechanisms.

6. License and Intellectual Property

The App, Website, and all associated content, features, and functionality (including software, design, text, graphics, and user interface elements) are owned by us or our licensors and are protected by intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, lawful, non-commercial purposes.

You must not (and must not attempt to): copy, modify, distribute, sell, lease, reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the App, except to the extent such restriction is prohibited by applicable law.

7. Acceptable Use

You agree not to use the App in any manner that:

  • Violates any applicable law or regulation
  • Interferes with, disrupts, damages, or attempts to gain unauthorized access to the App, Website, or related systems
  • Uses automated means (including scripts, bots, or scrapers) in a way that imposes an unreasonable load or undermines the App
  • Attempts to circumvent technical limitations, security measures, or access controls

8. Third-Party Services and Dependencies

The App depends on third-party products and services, including your browser, device, operating system, and hosting infrastructure. We are not responsible for the acts or omissions of third parties or for failures caused by third-party systems, updates, restrictions, or outages.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App and Website are provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express, implied, or statutory, including without limitation implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that the App will be uninterrupted, timely, secure, error-free, or that alarms will trigger or sound at any specific time.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your access to or use of (or inability to access or use) the App or Website, even if we have been advised of the possibility of such damages.

Without limiting the foregoing, we will not be liable for any damages arising from or related to missed alarms, delayed alarms, alarms that do not sound, or any reliance on alarms for work, travel, appointments, examinations, or other time-sensitive obligations.

11. Indemnity

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Totally Awesome Software and its owner(s), affiliates, and representatives from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the App, your violation of these Terms, or your violation of any applicable law or third-party rights.

12. Changes to the App; Suspension and Termination

We reserve the right to modify, suspend, or discontinue the App or Website (in whole or in part) at any time, with or without notice. We may also restrict, suspend, or terminate your access to the App at any time if we believe you have violated these Terms or if we choose to do so for operational, security, or legal reasons.

13. Changes to These Terms

We may update these Terms from time to time at our sole discretion. Any changes will be effective immediately upon posting the updated Terms on the Website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree that any dispute arising out of or relating to the App or these Terms will be brought exclusively in the courts located in British Columbia, Canada, and you irrevocably submit to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your use of the App and supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral, relating to the App.
